"L'ouvrage que nous propose aujourd'hui Mme Delphine Espagno est peut-être la plus belle des invitations qui ait été écrite afin d'inciter le lecteur, citoyen et/ou juriste, à comprendre la pensée du doyen de Bordeaux. Léon Duguit méritait effectivement le présent ouvrage et hommage car le doyen, comme Jean-Jacques Rousseau avant lui, a longtemps été et est encore souvent présenté soit comme un marginal de la pensée juridique, soit est même dédaigné de façon méprisante comme si sa qualité de juriste lui (...) était déniée. Hauriou, nous rappelle l'auteure, ira même ainsi jusqu'à affubler Duguit d'être un "anarchiste de la chaire" ce qui n'avait manifestement pas totalement déplu à ce dernier! Car, ce que rappelle Mme Espagno dès son introduction, c'est bien une nouvelle manière de penser et de réinventer le Droit dans son ensemble que nous invite à accomplir Léon Duguit. Il n'est pas qu'un faiseur de théorie(s) (comme celles du service public, des agents publics ou encore de l'Etat), il est - pour reprendre l'expression de Chenot désormais consacrée - un véritable "faiseur de système dans son sens le plus noble et mélioratif. Duguit assume en effet son rôle de guide et nous a donné à voir une nouvelle façon d'appréhender le Droit non pas tel qu'il est mais tel qu'il devrait être. Un Droit qu'il a comme réinventé en chaussant de nouvelles lunettes tel le spectateur qui verrait en deux dimensions et désormais en découvrirait - grâce à lui - une troisième. Après Léon Duguit, les juristes n'ont ainsi pu feindre de ne concevoir le Droit qu'à l'instar d'un artifice fictif, technique et juridique : le Droit est devenu indissociable de la sociologie. Ce "droit duguiste" nous offre alors grâce à la lumière qu'y dépose avec délicatesse Mme Delphine Espagno la vision renouvelée des relations existantes entre Droit, individu et collégialité ou société. En outre, ce que va construire le doyen de Bordeaux n'est pas - comme on le lit encore souvent - une "simple" théorie du service public mais une théorie réaliste de l'Etat par le service public", Mathieu Touzeil-Divina. What may we learn about the life of human beings with Evolutionary Biology? In order to answer this question, without taking a distrustful stance, I think that Daniel Dennett’s evolutionary cognitivism and Foucault s archaeological approach are not unreconciliable but complementary traditions. Indeed, Derrnett’s originality, thanks to his interpretation of the Baldwin Effect and his thesis of Self as a Narrative Center of Gravity, manages to present the human being’s world as the living fulfilment of a set of historical products, (...) without giving up the properly creative dimension of the individual . In this way, devices of domination and processes of « subjectivisation » belong to the broader transfornzative process of the evolution of life on Earth. In return, Dennett s philosophy, rightfully careful when it comes to political questions, should be complemented by a critical analysis. (shrink)

Le concept d’appartenance signifie pour Gadamer l’insertion de la connaissance dans l’être. Nous soutenons que la thèse fondamentale de Gadamer, l’être susceptible d’être compris est langage, ne signifie pas que l’être soit «soumis» au langage, mais suggère plutôt une certaine intelligibilité de l’être auquel l’homme participe par le biais de la connaissance. The starting point of this conversation with philosopher Mathieu Triclot is the issue of the causal contribution of video game playing in school shootings. Triclot explains the limitations of current psychological approaches regarding video game violence. He further develops on the peculiar features of the video game medium and how they relate to the problem of violence. Triclot eventually shows that, although players may relate to virtual violence in very different ways, violence in video games is not merely a (...) subjective phenomenon. High-fidelity cultural transmission, rather than brute intelligence, is the secret of our species’ success, or so many cultural evolutionists claim. It has been selected because it ensures the spread, stability and longevity of beneficial cultural traditions, and it supports cumulative cultural change. To play these roles, however, fidelity must be a causally-efficient property of cultural transmission. This is where the grain problem comes in and challenges the explanatory potency of fidelity. Assessing the degree of fidelity of any episode or mechanism (...) of cultural transmission always depends upon an investigator’s choice of grain of description at which cultural traditions are being studied. The fidelity of cultural transmission then appears to be relative to the granularity at which one approaches cultural variation, and since there is a multiplicity of grains of description by which the same tradition can be studied, there results a multiplicity of measures of fidelity for a same event or mechanism of cultural transmission. If this is correct, because fidelity is always relative to the grain of description dictated by the local and specific research interests of the investigator, then there seems to be no fact of the matter as to whether cultural transmission is faithful or not, independently from a researcher’s framework of analysis. The aims of this paper are to offer a conceptual clarification of the grain problem in cultural evolution, to assess its causes, to unpack its epistemological implications, and to examine its reach and consequences for a science of cultural evolution. A Polish space is not always homeomorphic to a computably presented Polish space. In this article, we examine degrees of non-computability of presenting homeomorphic copies of compact Polish spaces. We show that there exists a $\mathbf {0}'$ -computable low $_3$ compact Polish space which is not homeomorphic to a computable one, and that, for any natural number $n\geq 2$, there exists a Polish space $X_n$ such that exactly the high $_{n}$ -degrees are required to present the homeomorphism type of $X_n$. We propose a logic of abduction that (i) provides an appropriate formalization of the explanatory conditional, and that (ii) captures the defeasible nature of abductive inference. For (i), we argue that explanatory conditionals are non-classical, and rely on Brian Chellas’s work on conditional logics for providing an alternative formalization of the explanatory conditional. For (ii), we make use of the adaptive logics framework for modeling defeasible reasoning. According to Clifford Geertz, the purpose of anthropology is not to explain culture but to explicate it. That should cause us to rethink our relationship with machine learning. It is, we contend, perfectly possible that machine learning algorithms, which are unable to explain, and could even be unexplainable themselves, can still be of critical use in a process of explication. Thus, we report on an experiment with anthropological AI. From a dataset of 175K Facebook comments, we trained a neural network (...) to predict the emoji reaction associated with a comment and asked a group of human players to compete against the machine. We show that a) the machine can reach the same accuracy as the players, b) it fails in roughly the same ways as the players, and c) easily predictable emoji reactions tend to reflect unambiguous situations where interpretation is easy. We therefore repurpose the failures of the neural network to point us to deeper and more ambiguous situations where interpretation is hard and explication becomes both necessary and interesting. We use this experiment as a point of departure for discussing how experiences from anthropology, and in particular the tension between formalist ethnoscience and interpretive thick description, might contribute to debates about explainable AI. Although neuroscience is currently gaining wide acceptance in organization science and management studies, some important questions remain unanswered and may hinder the development of so-called organizational neuroscience. Specifically, it appears that the usefulness and the applications of neuroscience methods to organization science are still unclear. Hence, the paper addresses this by examining the role of psychophysiology in investigating implicit emotional experience in organizational behaviors and by discussing how concepts from affective sciences and psychophysiological methods could provide a more complete picture (...) of emotion in organization. Schools located in underpriviledged areas have to deal with different factors, like the dropout rate among students and teachers; the culture of action, the culture of oral and a «carpe diem» culture; the low literacy rates; the type of children's knowledges — sometimes different from those promoted at school — and the learning difficulties of pupils... In light of these factors, few states have decided to adopt measures to support pupils and teachers in these communities. In this sense, several studies (...) examine the potential role of philosophy for children (P4C), but none examines, in this kind of environment, the integration of P4C in the context of a teaching field experience program. Insofar several novice teachers start their career in these environments, it could be helpful to enrich our comprenhension on this subject. This paper presents results from an exploratory study on this issue, which led to raise questions about the bachelor of education program, at least in our university. (shrink)

If the condition of prostitution manifests itself as one of the clearest instances of domination in our societies, the paths to emancipation offered to those who are its victims prove to be contradictory, ranging as they do from the disappearance of venal sexuality, considered as a practice that is intrinsically inadmissible, to its fully-fledged recognition as a trade. In fact, the demands formulated by the movements of « sex workers » prove to be vulnerable in the face of the presumption (...) of alienation, while the goal of abolishing the practice of prostitution is open to the charge of paternalism, when it fails to meet with the approval of the prostitutes themselves. The article examines these rival paradigms for the emancipation of prostitutes. The issue of the social conditions which would render possible a questioning of the domination of these paradigms is central to the article’s argument. To do so, it examines the reflections on the process of subjectification we find in the writings of Foucault and Rancière, and it sketches out a number of possible analyses drawing on the sociology of Bourdieu and that which was initiated by Boltanski. Many engineering ethics classes and textbooks introduce theories such as utilitarianism and Kantianism (and most others draw from these theories without mentioning them explicitly). Yet using ethical theories to teach engineering ethics is not devoid of difficulty. First, their status is unclear (should one pick a single theory or use them all? does it make a difference?) Also, textbooks generally assume or fallaciously ‘prove’ that egoism (or even simply accounting for one’s interests) is wrong. Further, the drawbacks of ethical theories (...) are underestimated and the theories are also otherwise misrepresented to make them more suitable for engineering ethics as the authors construe it, viz. the ‘moral reasoning’ process. Stating in what various theories disagree would allow the students to frame the problem more productively in terms of motive–consequence or society–individual dichotomies rather than in terms of Kant–utilitarian. In fungi, cell fusion between genetically unlike individuals triggers a cell death reaction known as the incompatibility reaction. In Podospora anserina, the genes controlling this process belong to a gene family encoding STAND proteins with an N‐terminal cell death effector domain, a central NACHT domain and a C‐terminal WD‐repeat domain. These incompatibility genes are extremely polymorphic, subject to positive Darwinian selection and display a remarkable genetic plasticity allowing for constant diversification of the WD‐repeat domain responsible for recognition of non‐self. Remarkably, (...) the architecture of these proteins is related to pathogen‐recognition receptors ensuring innate immunity in plants and animals. Here, we hypothesize that these P. anserina incompatibility genes could be components of a yet‐unidentified innate immune system of fungi. As already proposed in the case of plant hybrid necrosis or graft rejection in mammals, incompatibility could be a by‐product of pathogen‐driven divergence in host defense genes. (shrink)

La base de données orales de français de Suisse romande (OFROM) contient des transcriptions d’enregistrements auxquels ont participé des locuteurs nés et vivant en Suisse. Elle a été créée par des linguistes soucieux de documenter les usages oraux du français en Suisse romande, et de combler ainsi le retard dans la description des usages oraux de la langue parlée dans cette partie de la francophonie, notamment sur le plan du lexique, de la syntaxe et de la phonologie. La base de (...) données OFROM a été mise en ligne en décembre 2012 ; elle est encore jeune et d’ampleur modeste (65 heures de parole pour près de 410 000 mots transcrits, au moment où nous écrivons), mais il est prévu de l’enrichir et de la diversifier régulièrement au cours des années à venir. La première partie de cet article présente les principes fondamentaux qui ont guidé la constitution de la base (choix des locuteurs, des supports et conventions de transcription, annotations, etc.). La seconde partie contient les résultats obtenus à l’issue d’études en cours ou de sondages prospectifs, portant sur la variation lexicale et la variation syntaxique. Ils permettront d’illustrer quelques-unes des potentialités qu’offrent la base et son moteur de recherche. (shrink)

Prominent ethical and policy issues such as affirmative action and female enrollment in science and engineering revolve around the idea that diversity is good. However, a precise definition is seldom provided. I show that diversity may be construed as a factual description, a craving for symmetry, an intrinsic good, an instrumental good, a symptom, or a side effect. These acceptions differ vastly in their nature and properties. Some are deeply mistaken and some others cannot lead to concrete policies. It is (...) thus necessary to clarify what one means by ‘diversity.’ It may be a neutral description of a given state; but this is insufficient to act. The idea that there should be the same representation in a specific context as in the overall population is both puzzling and arbitrary. Diversity as intrinsic good is a mere opinion, which cannot be concretely applied; moreover, the most commonly invoked forms of diversity are not intrinsically good. On the other hand, diversity as instrumental good can be evaluated empirically and can give rise to policies, but these may be very weak. Finally, symptoms and side effects are not actually about diversity. I consider the example of female enrollment in science and engineering, interpreting the various arguments found in the literature in light of this polysemy. (shrink)

La primera parte del artículo recrea los datos históricos fundamentales, la segunda explica su validez para los cristianos y las comunidades de nuestro tiempo.

There is now an awakening to and recognition of the emotionally complex lives of some non-human animals. While their forms of consciousness may vary, some are indeed conscious and deserve political consideration. What that political consideration ought to be is the central topic of this article. First, I argue that interspecies justice must be understood in terms of the relationships that foster individual flourishing of all concerned. The obstacles to such flourishing are the five faces of oppression famously identified by (...) Iris Marion Young: exploitation, marginalization, powerlessness, cultural imperialism, and violence. By extending Young’s concept of the social group to intra- and interspecies groups, we become more attuned to differences between and among species. Theorizing the existence of interspecies groups brings forward new avenues to explore oppression and simultaneously theorize its opposite – interspecies justice. Second, I argue that a positive theory of interspecies flourishing can be developed on the basis of Marx’s materialist philosophy and reclamation of species-being. Though Marx uses humanist language throughout the Economic and Philosophic Manuscripts of 1844, attention to his methodological commitments reveals that some non-human animals can no longer be excluded from the capability of flourishing and species-being. Some non-human animals are conscious, act purposefully, and labor creatively and must be included in our circle of moral and political concern. (shrink)

Sex allocation research has primarily focused on offspring sex‐ratio adjustment by mothers. Yet, fathers also benefit from producing more of the sex with greater fitness returns. Here, we review the state‐of‐the art in the study of male‐driven sex allocation and, counter to the current paradigm, we propose that males can adaptively influence offspring sex ratio through a wide variety of mechanisms. This includes differential production and motility of X‐ versus Y‐bearing sperms in mammals, variation in seminal fluid composition in haplo‐diploid (...) invertebrates, and epigenetic mechanisms in some fish and lizards exhibiting environmental sex determination. Conflicts of interest between mothers and fathers over offspring sex ratios can emerge, although many more studies are needed in this area. While many studies of sex allocation have focused on adaptive explanations with little attention to mechanisms, and vice versa, the integration of these two topics is essential for understanding male‐driven sex allocation. Nietzsche peut être considéré comme le plus français des philosophes allemands. Son école du style, dont il se déclare le premier Allemand à faire un problème sérieux, se trouve en France et remonte au XVIe siècle. De plus, sa critique de la métaphysique est liée à celle de la langue allemande qui se prête plus aisément à la fabrication de néologismes. Ainsi, la traduction des œuvres de Nietzsche en français fournit la tentation de livrer immédiatement dans la langue de traduction (...) le fonds original de sa pensée, quitte à prendre quelques libertés envers la langue vernaculaire de l'auteur. Dès lors, se trouve posé le problème de l'invention d'un style littéraire en philosophie, destiné à relever la métaphysique de son empire sur la philosophie.. On peut distinguer deux principales écoles de traduction des œuvres philosophiques de Nietzsche en français. Chacune, avec des stratégies tantôt littéraire et tantôt philosophique, semble avoir réussi le pari d'un « transfert culturel » bien plus que d'une simple traduction de Nietzsche en français. Cette double tradition est encore vivante aujourd'hui Nietzsche can be considered as the most French among German philosophers. His school of style, which he states himself as the first German to tackle philosophically and seriously on, can be found in France and goes back to the XVI century. Besides, his criticism of metaphysics is linked with that of the German language which indeed is far more easily to be linked with building neologisms. The translation in French of Nietzsche's works always provides a temptation to deliver immediately into the translation language the original basic thought, thus running the risk to take quite a few liberties towards the author's vernacular language. Hence the problem of an invention of a literary style in philosophy becomes set, intended as it is to relieve metaphysics from its influence over philosophy. One may distinguish two major schools for the French translations of Nietzsche's philosophical works. Each one them having different strategies, now more philosophical, now more literary, yet seeming to be succesful in the challenge of a « cultural transference » far more than in a mere translation of Nietzsche into French. This article examines a collection of singular artifacts, originating in the 1960s and 1970s, which I call "cybertrance" devices. These devices are based on the reappropriation of instruments from the academic world in order to place users in modified states of consciousness, far from the ordinary mode of wakefulness. All of these inventions draw on the heritage of American cybernetics, and re-articulate the man-machine concept central to it: passing from neo-mechanistic theory to experimentations with coupling and prostheses, and from rational (...) analysis to countercultural mysticism.If these cybertrance devices literally dismantle the man-machine, using technology to disorder the senses, in no way do they seek to... Many people hold this truth to be self-evident that universities should enroll more female students in science and engineering; the main question then being how. Typical arguments include possible benefits to women, possible benefits to the economy, and the unfairness of the current female under-representation. However, when clearly stated and scrutinized these arguments in fact lead to the conclusion that there should be more women in scientific disciplines in higher education in the sense that we should expect more women (which (...) various kinds of discrimination may prevent), not that we should actively enroll more women. Outreach programs towards high school students may therefore be logically incompatible with the arguments supposed to justify them. They should purport to allow women to graduate in a field congruent with her abilities and desires, rather than try to draw as many of them to scientific disciplines as possible: one cannot try to ‘recruit’ as many female students as possible while claiming to help them choose more freely. Even when inconsistencies are present in our premise set, we can sensibly distinguish between good and bad arguments relying on these premises. In making this distinction, the inconsistency-adaptive approach of Batens strikes a particularly nice balance between inconsistency-tolerance and inferential strength. In this paper, we use the machinery of Batens’ approach to extend the paraconsistent approach to dialogical logic as developed by Rahman and Carnielli. In bringing these frameworks closer together, we obtain a dynamic mechanism for the systematic study of (...) dialogues in which two parties exchange arguments over a central claim, in the possible presence of inconsistencies. A leading idea of cultural evolutionary theory is that for human cultures to undergo evolutionary change, cultural transmission must generally serve as a high-fidelity copying process. In analogy to genetic inheritance, the high fidelity of human cultural transmission would act as a safeguard against the transformation and loss of cultural information, thus ensuring both the stability and longevity of cultural traditions. Cultural fidelity would also serve as the key difference-maker between human cumulative cultures and non-human non-cumulative traditions, explaining why only (...) us humans, with our uniquely high-fidelity transmission capabilities, are capable of evolving and sustaining complex traditions. But what does it mean for cultural transmission to be more or less faithful? This article has two objectives. The first is to clarify the meaning and uses of the concept of cultural fidelity and to evaluate their explanatory import. I argue that cultural evolutionists use several fidelity concepts (episodic, propensity, and generalized fidelity), concepts that I will define and clarify. The second objective is to challenge the explanatory significance of a general notion of fidelity (generalized fidelity) as being both explanatorily meaningful and operationalizable.
